A New York appellate court ruled that a contractor was not entitled to summary judgment dismissing a drywall worker’s Labor Law and negligence claims for an alleged accident.

Case: Londono v. Dalen LLC, No. 2019-12812, 04/06/2022, published.

Facts: Reinaldo Hincapie Londono allegedly was injured during the course of performing drywall finishing work at a property owned by Dalen LLC and leased to BAM Hospitality LLC.

BAM was in the process of renovating the leased premises and had hired A&L Construction Services to perform work.

Londono worked for Par Wall Finishing Inc….
